Terms of service
Last updated
These terms are the agreement between you and Unified Supply LLC, which operates CartSwipe, for using the CartSwipe service and website. Read them together with the Privacy policy, the Refund policy and the billing terms. CartSwipe asks you, before you use the portal, to confirm you're 18 or older and to agree to these terms and the Privacy policy. By agreeing there, or by using CartSwipe, you agree to these terms.
What CartSwipe does
CartSwipe is a managed checkout service. You choose products and the retailer accounts to use, and the owner sets up CartSwipe's checkout software, which runs on a computer the owner controls, to try to buy them for you when they're released. Nothing runs on your computer.
CartSwipe checks out on Target only today.
Purchases are made on your retailer account, with your card. The retailer charges your card for the merchandise and ships it to you. CartSwipe charges a separate service fee for each item it successfully buys.
In these terms, "CartSwipe" means Unified Supply LLC and the CartSwipe service, "the owner" means the person who runs CartSwipe for Unified Supply LLC, and "the retailer" means the store CartSwipe checks out on for you (today, Target).
No guarantee of a purchase
High-demand releases sell out fast, and many checkout attempts fail. CartSwipe doesn't guarantee that it will buy any product, in any quantity or at any price, or that the retailer will keep and ship an order. You pay a service fee only for items that are successfully purchased.
Who can use CartSwipe
- You must be at least 18 and able to make a binding agreement. CartSwipe asks you to confirm your age before you use the portal.
- You need a Discord account and membership of the CartSwipe Discord server. You sign in with Discord, so keep your Discord account secure: whoever controls it controls your CartSwipe account.
- Each CartSwipe account includes three retailer account slots. The owner can grant more.
- Give accurate information and keep it up to date.
- CartSwipe may pause new sign-ups at any time. While sign-ups are paused, people who don't already have a CartSwipe account are turned away when they sign in. They can sign in again once sign-ups reopen.
Your retailer account, mailbox and card
- You must own the retailer account, mailbox and payment card you add, or be authorized to use them.
- You authorize CartSwipe to sign in to your retailer account, read the verification code the retailer emails to your mailbox, and pay with your card, to buy the products you've selected.
- Each purchase is between you and the retailer (today, Target), and the retailer's terms apply, including its purchase limits and its right to cancel orders.
- Retailers may limit purchases, cancel orders, or restrict or close accounts they believe use automated checkout. You accept that risk. CartSwipe isn't responsible for what the retailer does.
- Your retailer login, mailbox access and card are each deleted automatically if the owner hasn't finished your setup within 7 days of when you saved it. You'll then need to add it again.
- If you think any of these details has been misused, tell the owner straight away, in the CartSwipe Discord or by email to support@cartswipe.app, and change the password.
Fees
CartSwipe charges a service fee for each successfully purchased item. The fees are listed in the Service fees section of the CartSwipe home page. A fee marked with + is a starting fee: the exact fee for a release is confirmed in the CartSwipe Discord before it runs. The fee for a product the list doesn't cover is also confirmed in the CartSwipe Discord before the release runs.
There's no signup fee and no subscription. The merchandise price, shipping and tax are charged by the retailer, not by CartSwipe.
Invoices and payment
- After a release, CartSwipe combines the items it bought for you into one invoice. Stripe emails it to your billing email, and it's also on your Billing page.
- Payment is due at least 48 hours after the invoice is sent. Your Billing page shows the exact deadline in Eastern Time.
- Pay each invoice in full, in one payment, on Stripe's payment page. Partial payments aren't accepted. If a payment fails, you can try again.
- If an invoice isn't paid on time, your account is overdue, and the owner may pause your retailer accounts in the checkout software until it's paid.
- Once CartSwipe switches on billing follow-up, an overdue balance also gets a one-time 1.5% late fee after seven full Eastern calendar days past the due date, then a final deadline. If the balance is still unpaid after that, your access to the CartSwipe Discord and portal is removed. The billing terms say whether billing follow-up is switched on.
The billing terms give the full details. If they and these terms differ on a billing matter, the billing terms apply.
Cancellations and refunds
Canceled items, mistaken charges and refunds of service fees follow the Refund policy. Refunds for merchandise come from the retailer.
Acceptable use
Don't:
- use someone else's Discord account, retailer account, mailbox or card without permission;
- give false information, or use CartSwipe for fraud;
- try to reach other people's data, probe or attack CartSwipe's security, or overload the service;
- use bots, scrapers or other automated means against the CartSwipe website or its sign-in;
- try to get around CartSwipe's security checks, or its limits on repeated sign-in and payment-page attempts;
- share, sell or rent your CartSwipe access;
- harass the owner or other members.
Suspension and ending
- You can stop using CartSwipe at any time. Remove your setup details or retailer accounts in the portal, and ask for erasure in the CartSwipe Discord or by email to support@cartswipe.app (see the Privacy policy). Invoices for purchases already made are still payable, and erasure waits until they're settled.
- The owner may block your CartSwipe account, pause your retailer accounts in the checkout software, or remove you from the CartSwipe Discord if you break these terms, don't pay, or put CartSwipe or others at risk. A block ends your portal access. It doesn't cancel what you owe.
- If the owner blocks you or ends your access because you broke these terms, you may not create another CartSwipe account, for example by signing in with another Discord account, to get around it. Asking for erasure isn't the same as being blocked. After an erasure you can sign up again later as a new customer, as the Privacy policy says. But an erasure doesn't lift a block for breaking these terms.
- CartSwipe may change or stop the service. If it stops, CartSwipe will say so in the CartSwipe Discord and will bill only for purchases already made.
Your data
The Privacy policy explains what CartSwipe collects and how it's used.
CartSwipe's database provider keeps backups for up to 8 days, as the Privacy policy explains.
Even so, to the extent the law allows, CartSwipe isn't liable if information you give it is lost or corrupted. If that happens, you may need to enter it again.
This doesn't change the Privacy policy's security section. If something happens that affects your information, CartSwipe will still tell affected customers as the law requires.
The CartSwipe website and your feedback
CartSwipe owns the CartSwipe website's content, design and code, and the CartSwipe name and logo, or uses them under license.
You may use the website to learn about CartSwipe and to use the CartSwipe service. That right is limited, can be withdrawn and can't be transferred to anyone else. Don't copy or reuse the website's content, design or code, or the CartSwipe name or logo, commercially without the owner's permission.
If you send CartSwipe suggestions or feedback about the service, CartSwipe may use them without paying you. This applies only to suggestions and feedback, not to your personal information, your support messages or any cancellation proof you send. CartSwipe treats those as your personal information, under the Privacy policy.
Other websites
The CartSwipe website links to other websites, such as Discord, Stripe's payment page and service providers' privacy policies. Those websites, and the retailer's website, have their own terms and policies, which apply when you use them. CartSwipe doesn't control them and isn't responsible for them.
Disclaimers
CartSwipe is provided "as is" and "as available". To the extent the law allows, CartSwipe makes no promises beyond those in these terms. That includes no promise that the service will be uninterrupted or error-free, or that any product can be bought.
CartSwipe depends on services it doesn't control, including the retailer (today, Target), Discord, Stripe and the maker of its checkout software. CartSwipe isn't responsible for their outages, decisions or changes.
Limit of liability
To the extent the law allows, CartSwipe isn't liable for indirect or consequential losses, such as a missed release, lost resale profit, or a restriction on your retailer account. CartSwipe's total liability to you for any claim is limited to the service fees you paid CartSwipe in the three months before the claim.
These limits, and the rest of these terms, don't reduce a refund that the Refund policy or the billing terms give you.
Some state laws don't allow some of the limits, exclusions and disclaimers in these terms, so they may not all apply to you.
Indemnification
You agree to indemnify CartSwipe (Unified Supply LLC, its owner and its agents). That means: if someone else makes a claim against them because of any of the following, you'll defend them and pay their losses and costs, including reasonable attorneys' fees:
- your breach of these terms;
- your use of a Discord account, retailer account, mailbox or payment card you weren't authorized to use;
- your breaking the law or violating someone else's rights.
This doesn't cover a claim that arises only because CartSwipe did what you authorized in these terms: signing in to your retailer account, reading the verification code the retailer emails to your mailbox, and paying with your card to buy the products you've selected.
CartSwipe may take over the defense of such a claim, at your expense. CartSwipe will try to tell you about such a claim when it learns of it.
Changes to these terms
CartSwipe may update these terms. The new version will be posted here with a new date, and important changes will be announced in the CartSwipe Discord. After an important change, CartSwipe will ask you to agree to the new terms before you use the portal again. If you keep using CartSwipe after a change, the new terms apply.
Governing law and disputes
These terms are governed by the laws of Virginia, United States, without regard to conflict-of-law rules.
This section applies except where the law where you live gives you rights these terms can't take away.
Electronic communications
CartSwipe gives you notices on the CartSwipe website and in the CartSwipe Discord, and Stripe emails your invoices to your billing email. You can give CartSwipe notices in the CartSwipe Discord or by email to support@cartswipe.app. Where these terms, the billing terms or the Refund policy say where to send something, such as cancellation proof, send it there.
You agree that notices and agreements given electronically in these ways, including agreements you make on the CartSwipe website, satisfy any requirement that they be in writing, to the extent the law allows.
You agree to the use of electronic records and electronic signatures in place of paper ones.

General terms
- Whole agreement. These terms, the Privacy policy, the Refund policy and the billing terms are the whole agreement between you and CartSwipe about the service. That includes the service fees listed on the CartSwipe home page and any fee confirmed in the CartSwipe Discord, as the Fees section explains.
- No waiver. If CartSwipe doesn't enforce part of these terms, that isn't a waiver, and CartSwipe can still enforce it later.
- Severability. If any part of these terms can't be enforced, the rest still applies.
- Transfer. CartSwipe may transfer these terms, with its rights and duties under them, if its business is sold, merged or reorganized. You may not transfer your rights or duties under these terms.
- Events beyond CartSwipe's control. CartSwipe isn't responsible for delays or failures caused by events beyond its reasonable control, such as outages at Discord, the retailer, Stripe or CartSwipe's hosting providers, internet failures, or natural events like storms or floods.
- Relationship. These terms don't create a partnership, joint venture or employment relationship between you and CartSwipe. When CartSwipe signs in to your retailer account and pays with your card, it does so on your behalf, as you authorized in these terms.
- Interpretation. You and CartSwipe agree that these terms won't be read against CartSwipe just because CartSwipe wrote them.
Trademarks
CartSwipe is an independent service. It isn't affiliated with, endorsed by or sponsored by Target, The Pokémon Company, Nintendo or Discord. Their names are used only to describe what CartSwipe works with, and their trademarks belong to their owners.
